Sweepstakes violators face fines and license loss

Violators face fines of $10,000 to $100,000 for each violation and possible gaming-license loss or ineligibility. The State Gaming Commission, State Police, and Attorney General can investigate, hold hearings, send cease-and-desist letters, and issue subpoenas. The Commission or Attorney General can also block persons or affiliates from starting or continuing operations. That authority applies when they knowingly accept revenue from online sweepstakes games.

New York bans online sweepstakes games

Effective immediately upon enactment, New York bans running, conducting, promoting, or supporting covered online sweepstakes games. Covered internet and device-based games use two currencies and offer cash prizes, cash equivalents, or chances to win cash. The State Gaming Commission must decide what counts as a two-currency system. The ban covers gaming applicants, licensees, employees, investors, board members, banks, payment processors, location-service providers, game suppliers, platforms, and media affiliates. Covered games simulate casino-style play, including blackjack, roulette, craps, poker, lottery draws, instant-win games, and keno.

Sweepstakes fines fund gambling treatment and education

The State Gaming Commission must deposit all fines from sweepstakes violations into the Commercial Gaming Revenue Fund. That money supports problem gambling education and treatment. The law sets no fixed funding amount; available money depends on fines collected.
