Courts must explain child welfare findings

New York Family Court must give notice before accepting a person's admission or consent in a child abuse or neglect case. The court must explain that this results in a formal finding of abuse or neglect and explain the possible consequences. The law takes effect on the same date and in the same manner as the companion 2024 law on these notices.

Child welfare records affect job screening

Reports tied to court findings of abuse or neglect stay marked as indicated in the state's child welfare register. They remain until 10 years after the youngest named child's 18th birthday, unless the finding is vacated or dismissed. The person named cannot amend the report through the register. Employers may learn that the report exists when screening job or volunteer applicants for potential regular, substantial contact with children. Child care agencies may also learn this when the person applies to foster or adopt. Disclosure is barred for neglect findings when the report is at least eight years old. It is also barred if an earlier administrative review found the report irrelevant to work involving contact with children. The law removes automatic sealing of neglect findings after eight years.
