Broader labor protections for New York workers

Effective upon enactment, the law stops excluding workers from New York's labor relations law solely because federal labor law covers them. Exclusions remain for state and local government employees, including agency employees, and workers whose employers agree with the board that the federal Railway Labor Act protects them. Workers also remain excluded where the National Labor Relations Board has jurisdiction under a federal district court order. For covered workers, New York's labor board must promptly certify an exclusive bargaining representative upon application and verification of prior certification by another state or federal agency. Existing employment terms between the employer and certified representative stay in force throughout verification.
