Effective immediately upon enactment, the law requires written rules for taking over leases in New York City Housing Authority (NYCHA) housing. This applies to units NYCHA owns and operates when the named tenant permanently leaves or dies. The rules must explain who qualifies and any required move, while following applicable laws, regulations, guidance, and NYCHA occupancy standards. Claimants must pay charges for using the unit while their claim is pending. They can challenge a denial through an administrative grievance, subject to limits in NYCHA's succession rules. Taking over a lease is not guaranteed. Before significant rule changes, NYCHA must give written notice at least 30 days ahead and allow and consider written comments.
