If a NYCHA tenant dies or permanently leaves, eligible occupants can claim the right to stay. NYCHA must keep written rules that match federal, state, and local law. The rules must say who qualifies and any relocation steps. They must also explain if payment is needed during review and how to appeal a denial. NYCHA must give at least 30 days’ notice before changing these rules and take written public comments. The law takes effect immediately.
