Advertisers must label AI-made performers

Advertisers that create business ads in New York must clearly say when a synthetic performer appears. This applies when you or your staff have actual knowledge the ad uses a computer-made performer. “Synthetic performer” means a computer-created person made with AI. The first violation is a $1,000 civil penalty; later violations are $5,000 each. These rules apply starting 180 days after it became law.

Some ads are exempt from AI labels

Some ads do not need this label. Ads that promote movies, TV, streaming shows, documentaries, or video games are exempt when the synthetic performer is used the same way in the ad and in the work. Audio-only ads are also exempt. Ads that use AI only to translate a real person’s speech are exempt.

Publisher rules and penalties for AI ads

Publishers and platforms are not liable unless they get written notice that an ad has a synthetic performer. After notice, they must stop running the ad or add the label within five days, or as soon as they can. They also may not remove or change a required label. The first violation is a $1,000 civil penalty; later violations are $5,000 each.
