Businesses must label synthetic performers
Starting on the 180th day after becoming law, businesses selling property or services must clearly label synthetic performers in commercial ads they create. Synthetic performers are digital assets made or changed with artificial intelligence or software to resemble living performers. Disclosure is required when the business, its agent, or its employee actually knows one is used. Audio ads and ads using artificial intelligence only to translate a human performer's language are exempt. Ads promoting expressive works, such as movies or games, are exempt when the performer's use matches the work. Violations carry a $1,000 civil penalty for the first violation and $5,000 for each later violation.
Publishers must preserve synthetic performer notices
Starting on the 180th day after becoming law, publishers and distributors cannot remove, destroy, or change required synthetic-performer notices. Violations carry a $1,000 civil penalty for the first violation and $5,000 for each later violation. A publishing medium is generally exempt when an ad lacks a required notice. That exemption ends after the medium or its employees receive written notification establishing actual knowledge of the synthetic performer. The medium must then get no more than five days, or as soon as technically or practically feasible, to stop distribution or add the notice.
