Protections for existing cannabis licenses

The law takes effect immediately. Licenses issued before the effective date are treated as meeting the new distance rules. Renewal cannot be denied only because a store is within the new distance limits. The Office of Cannabis Management uses the date you submit your location to judge distance compliance. If the Office told you in writing before the effective date that your site complied, your application is reviewed under the older procedures used before July 28, 2025. All other applications are reviewed under the new rules.

New distance limits for cannabis shops

Retail adult-use cannabis stores cannot be on the same street and within 500 feet of a school or within 200 feet of a house of worship. Distance is a straight line from the center of the nearest entrance of the store to the center of the nearest entrance of the school or house of worship. An entrance is a door students, the public, or customers regularly use; emergency-only and delivery doors do not count. If a building is set back, measure to the center of the walkway or steps where they meet the building line or public street. A building still counts as a house of worship even if it hosts bingo, fundraisers, services by other faith groups, social events, support meetings, yoga or health drives, or private events, and even if it accepts money to cover costs.
