Up to 5% tax allowed on Minisink stays

The law lets Minisink adopt a hotel or motel tax on room stays. Any local rate can be up to 5% of the daily room price. People who stay 90 straight days or more are permanent residents and do not pay this tax. The tax also does not apply to New York State, certain public bodies, the immune federal government, or qualifying nonprofits. All money goes to the town’s general fund for local services. Each local law can last up to three years, and the state authorization ends three years after enactment.

Minisink hotel owners must collect tax

The town’s chief fiscal officer runs and collects the hotel tax. Owners or operators must collect the tax from guests and pay it to the town. They have the same right to collect it as rent, and the town officer is joined in any court action to collect. Returns are due monthly or on another schedule set by local law. Owners can ask a court to review a final tax decision within 30 days, after depositing the tax (plus interest and penalties) or filing a court‑approved undertaking. The town cannot assess more tax more than three years after you file, unless the return was willfully false or fraudulent; if no return is filed, there is no time limit.
