New drone no-fly rules near critical sites

Beginning Nov 1, 2026, it is a crime to fly a drone under 400 feet over a covered critical infrastructure site. It is also a crime to let a drone touch the site or fly close enough to disturb its operations. Criminal liability applies only when the person acts intentionally or knowingly. Violations carry state criminal penalties under Title 21, Section 1792, and civil damages for harm to property, the environment, or human health.

Who can fly and what sites count

Beginning Nov 1, 2026, the law defines which sites are "critical infrastructure." Covered sites include refineries and chemical plants; power plants and substations; water and wastewater plants and pump stations; gas, pipeline, LNG, and storage sites; telecom centers and cell towers; ports, rail yards, and trucking terminals; radio/TV transmitters; certain steel mills; DHS CFATS sites; and state- or federally regulated dams. The site must be fenced or clearly signed, or be an aboveground pipeline behind a barrier. Some flights are still allowed: by federal, state, or local government and their contractors; law enforcement; facility owners and their contractors; people with prior written consent; and FAA-authorized commercial operators for that airspace.
