Homeowners can file title theft notice

Beginning November 1, 2026, victims of title theft, or someone filing for a disabled victim, can record a sworn notice. The notice must fully describe the property and be filed with the county clerk where the land is located. The clerk records and indexes it like a deed and lists the victim's name as a grantee. This puts your fraud claim on the public record.

No fee to file quiet title

Beginning November 1, 2026, the clerk cannot charge a filing fee for an order to quiet title when restoring title after a fraudulent conveyance. This removes one court filing cost for victims.

DA and police get the notice

Beginning November 1, 2026, when a notice of fraudulent conveyance is filed, the county clerk sends a copy to the district attorney and local police where the property is located. This alerts law enforcement to investigate possible title theft.

Recording fees for title theft notices

Beginning November 1, 2026, you may have to pay the county's standard recording fee when you file a notice of fraudulent conveyance. The fee follows the county clerk fee schedule in state law.

Court can order recording; sham filings blocked

Beginning November 1, 2026, if a county clerk refuses your notice, you can ask the district court for a writ to make the clerk record it. A clerk may refuse to file a notice the clerk reasonably believes is sham legal process or slander of title.
