Beginning November 1, 2025, Oklahoma extends its Plugging Fund maintenance date from July 1, 2026, to July 1, 2031. The required fund balance is $5 million. If the balance falls below that level, the Corporation Commission must notify the Tax Commission to impose the applicable oil and gas excise tax. The Tax Commission must notify taxpayers, and collection continues until the balance is restored. This tax mechanism ends July 1, 2031. The fund supports plugging work, carries money across fiscal years, and does not require legislative appropriations. Each fiscal year, the Corporation Commission can spend up to 8% of the prior year's deposits on seeping natural gas responses. It can also fund immediate emergencies within its authority that threaten the environment or public safety, following state purchasing rules. Payments require an authorized Commission employee's signed claim, state management office approval, and State Treasurer processing. Existing surety bond requirements remain unchanged.
