Service Oklahoma must revoke driving privileges after receiving a sworn officer report of suspected impaired driving and test refusal. The officer must report reasonable grounds to believe the person drove or physically controlled a vehicle while under the influence. This covers alcohol, other intoxicating substances, or both, and includes nonresident driving privileges. Revocation takes effect 45 days after notice.
Eligible drivers get more time to enroll in the Impaired Driver Accountability Program. The Board of Tests for Alcohol and Drug Influence must receive the enrollment request and required fee within 30 calendar days. That clock starts when the driver receives Service Oklahoma’s revocation notice, rather than on the arrest date. Drivers must have held a Class D license at arrest and remain eligible for Oklahoma driving privileges when enrolling. They must not have driven or physically controlled a commercial vehicle at arrest. The changes apply to arrests on or after November 1, 2022.
Some drivers cannot have their records show Impaired Driver Accountability Program completion without a revocation. This exclusion covers drivers subject to revocation under Title 47, Section 6-205.1(A)(2). Completing the program does not give these drivers access to that special record update.
