The Oklahoma County Clerk takes over Oklahoma’s farm-product filing system from the Secretary of State. The system starts 180 days after certification by the U.S. Department of Agriculture. Filings active on the act’s effective date must transfer using the Clerk’s transition document, with no migration fee. The Clerk handles forms, records, registrant services, and system rules. Financing statements have no priority among themselves within this system; the Clerk processes them in recorded timestamp order.
When the system starts, the County Clerk collects $10 for each financing statement, continuation, partial release, assignment, amendment, or termination. Written confirmation of active statements costs $6. Annual buyer or interested-party registration costs $50, but Internet-download access waives that fee and downloads are free. Master-list distribution charges depend on products and counties; fees for five or fewer counties range from $150–$300 yearly. A transfer fee cannot exceed the Clerk’s cost, and collected fees go to the Clerk’s Uniform Commercial Code Central Filing Fund.
Debtors no longer sign farm-product financing statements; secured lenders still sign and file them with the required information. Termination statements must now identify the financing statement by its unique document number. The existing 20-day termination deadline remains once no secured obligation or commitment to provide further value remains. The Oklahoma County District Attorney replaces the Attorney General in enforcing the existing $500 failure-to-file penalty; collections fund the Clerk’s filing system. Statements remain publicly searchable but inactive when their term expires or a termination statement is accepted, whichever happens first.
