You must use the Oklahoma State Treasurer’s claim form; using another form makes the claim invalid. Include a readable copy of your valid driver license, or accepted alternative identification or evidence if you lack one. A representative filing for you must include a signed written agreement, including a power of attorney. The Treasurer may waive claim requirements and send property directly to someone listed as its apparent owner in a report. The Treasurer must reasonably believe that person is entitled to the property and verify their identity and address.
The Treasurer must send written notice of full or partial denials to claimants and their representatives, when applicable, by email or mail. No denial notice is required when the claim provides neither a notice address nor a claimant address. The Treasurer may hold a hearing; you or your representative must show entitlement is more likely than not. Hearings on denied claims follow the Administrative Procedures Act’s rules for admitting evidence in contested cases. After a hearing, the Treasurer must issue written findings and reasons in a public decision that is the agency’s final decision.
Beginning November 1, 2025, claims for deceased owners require court or other lawful documents showing entitlement before payment or delivery. Property worth $10,000 or more when paid also requires a certified death record from a government office maintaining those records. Claimants may use Oklahoma’s specified small-estate affidavit for accounts previously held by banks, credit unions, or savings and loan associations. This replaces the prior claimant-affidavit requirement for property worth $25,000 or less.
Recovery-service agreements made on or after November 1, 2021 must be written and signed by the claimant, by hand or electronically. Helper fees are capped at 25% of recovered value, and mineral proceeds are excluded from these fees. For approved representative-filed claims, the Treasurer pays you the balance after deducting the representative’s agreed amount. Both you and the representative must be paid within 60 days after approval, following the written agreement. The representative’s fees and costs may be paid by paper check or another Treasurer-approved method.
The Treasurer must provide requested copies of wills, trusts, codicils, or amendments received from safe-deposit boxes or safekeeping repositories. You or your representative must provide evidence of the document maker’s death and your apparent ownership. Box contents may be released directly to you, or to your representative or a commercial carrier with your written authorization. Any lien owed to the box lessor must be paid before release. Alternatively, you or your representative may choose deduction of the lien at the next scheduled auction, with the remaining value distributed.
