Higher legal cost payments for injured workers

The law raises Oregon’s legal cost payment limit from $1,500 to $3,500 for workers who finally win against workers’ compensation denials. A court, board, or administrative law judge must order payment of reasonable costs for records, expert opinions, and witness fees. The insurer or self-insured employer pays these costs in addition to the worker’s compensation. Workers can receive more than the limit by showing extraordinary circumstances. Each July 1, the limit adjusts for any percentage increase in Oregon’s average weekly wage, rounded to the nearest $100.
