Oregon public employers must send authorized payroll deductions to labor organizations on their payroll processing schedule, within 30 calendar days. This deadline applies after the organization supplies the required list of employees who authorized deductions. It changes when the organization receives the money, not how much comes out of workers’ pay.
Oregon’s Employment Relations Board must fine public employers that repeat violations of ORS 243.804(4) or ORS 243.806(7). A violation after a prior violation brings a $1,000 to $5,000 fine; a subsequent violation brings $5,000 to $10,000. The Board must consider extenuating circumstances the employer proves. No fine applies if the employer proves a natural disaster, computer crime, or qualifying catastrophe directly caused the violation. That event must also have significantly disrupted related operations.
