For covered, unsettled complaints, Oregon’s Bureau of Labor and Industries (BOLI) must send a notice explaining court filing deadlines. Notice is due upon dismissal within the first year, unless dismissal follows a lawsuit, or on the complaint’s one-year anniversary. If BOLI finds substantial evidence or does not investigate, workers have 90 days after notice when 90 days or less remain. If more than 90 days remain, the existing legal deadline applies. If BOLI finds no substantial evidence, workers have one year after notice when more than one year remains. When 90 days to one year remain, the existing deadline applies; when fewer than 90 days remain, workers have 90 days after notice. The notice must warn that missing the deadline means losing the right to sue. These rules exclude claims under ORS 659A.145, 659A.403, 659A.406, and 659A.421, and federal housing discrimination claims. The law takes effect immediately upon passage. These rules cover complaints and lawsuits filed from that date, plus earlier complaints where no 90-day notice has been issued.
Oregon employers cannot make current workers, former workers, or job applicants agree to shorter legal deadlines for covered claims. The ban covers violations that the Bureau of Labor and Industries (BOLI) can enforce. It applies to agreements made on or after the law’s effective date, which is immediately upon passage.
