The law extends its surgery approval protection to trusts providing health benefits for multiple employers. Beginning January 1, 2027, both the surgery protection and electronic approval rules apply to these trusts and health care service contractors. For contractors, these rules apply only where they do not conflict with specific Oregon laws governing them. Employer trusts are treated as insurers, their contributions as premiums, and their health benefits as health insurance.
Beginning January 1, 2027, Oregon health insurers using medical coverage reviews must provide a standard electronic prior authorization interface. This applies whether insurers conduct reviews themselves or use another company. Providers must be able to check approval requirements and required documents through their electronic health records or practice systems. They must also be able to securely exchange requests and decisions, with insurers responding through the same interface. The interface must meet federal standards in 45 C.F.R. 156.223(b), as in effect on February 28, 2024.
Insurers cannot require separate approval for a qualifying added or related procedure found during an already approved surgery. The provider must find it medically necessary under generally accepted medical standards. The provider must also decide that delaying or interrupting care for approval is not medically advisable. The procedure must be covered by the patient's plan and cannot be experimental or investigational.
