2 provisions identified: 0 benefits, 1 costs, 1 mixed.
Landowners with a substantial ownership stake share liability when they knew or should have known about a farmworker camp. They can face court orders and responsibility for the full damages owed alongside the operator. Producing a written lease banning unregistered camps creates a presumption that the landowner neither knew nor reasonably could have known. The ban must cover operation by the tenant or anyone else. Evidence showing knowledge was more likely than not, including what the landowner should have known, can overcome that presumption.
Farmworker camp operators must have registration or endorsement before collecting camp fees or bringing related court actions. People harmed by covered camp violations can sue for damages and court orders to stop violations. When damages are found against a covered operator, recovery is actual damages or $2,000, whichever is greater. The minimum rises from $500. The winning party can recover court costs and reasonable attorney fees. Oregon's labor commissioner, consumer and business services director, and local government agencies can also sue to stop violations.
