These Oregon rules apply to rental hold deposits received on or after January 1, 2026, not earlier deposits. Landlords can charge a hold deposit only after approving an application and before entering into a rental agreement. Before taking it, they must provide written details about rent, fees, required deposits, signing terms, and refund rules. Once the rental agreement is signed, landlords must credit the deposit toward money owed or refund it immediately. Landlords may keep the deposit if the applicant fails to follow the agreement to sign, except for serious habitability defects. If the landlord breaks that agreement, or the applicant rejects the rental because of those defects, a five-business-day refund deadline applies. Landlords must make that refund available at their usual business location or send it by first-class mail. Applicants or tenants can recover an improperly charged fee or deposit, plus $150, when landlords violate the rules. Missing the five-business-day deadline also allows an extra penalty equal to the larger of the deposit or an agreed amount. That extra penalty does not apply when an act of God caused the delay.
