New power rules for large facilities

Oregon requires separate electricity rates for facilities using, or able to use, at least 20 megawatts. They must also mainly provide services under industry code 518210. Rates must assign their service costs to them and limit unfair cost or risk shifts to other customers. Regulators must also review effects on grid benefits and state clean-energy goals. Until a utility’s rate plan is approved, using the separate class is optional; that exception ends January 2, 2028. Utilities must make service contracts lasting at least 10 years, with minimum payments based on expected use. Contracts must state a service start date or estimate and may charge for demand above contracted levels. Utilities must notify facilities of missed specified start dates caused by problems within their reasonable control. The contract rules cover agreements made on or after the law took effect upon passage. Earlier contracts are also covered when later service investments or costs could raise costs or risks for other customers. Direct access and green-power options remain available when they comply with the new rules. Regulators must report on large-user electricity demand by September 1 of each even-numbered year; reporting ends January 2, 2035.
