Oregon law lets recipients sue someone who, at age 18 or older, electronically sends them an intimate image without consent. The image must show sexual conduct, as defined by state law, or uncovered human genitals. The sender must intend to harass, degrade, or humiliate the recipient and know, or reasonably should know, consent is absent. The recipient must experience that harm, and a reasonable person must also find the transmission harassing, degrading, or humiliating. Recovery is the greater of $500 or proven financial and nonfinancial harm, capped at $10,000 across all such transmissions. Courts must also award reasonable attorney fees to recipients who win. Recipients must sue within two years of the conduct; the law covers claims arising on or after its effective date. Exemptions cover internet and mobile data providers and app operators acting as intermediaries for communications initiated or directed by others. Services transmitting intimate images, including on-demand, subscription, and ad-supported services, are also exempt, as are health care providers sending images for legitimate medical purposes.
