Oregon creates a faster licensing process for eligible health care facilities, with licenses due within 45 days after filing. The facility must replace the same type of facility at the same location, without major structural or functional changes. The former facility must have closed voluntarily or because of financial hardship within the past 60 months. Applicants must already operate the same facility type in Oregon, be in good standing, and have no unresolved compliance issues at their Oregon facilities. Licensed providers working at those facilities must also have licenses in good standing. Applicant checks include parent corporations and entities linked through ownership, governance, control, or membership. The proposed facility must meet state rules, though the Oregon Health Authority can waive requirements, including appropriate construction and inspection requirements. Long-term care facilities and residential facilities mainly serving people under 21 are excluded. License surrender during a licensing or abuse investigation, or through an agreement to avoid revocation, bars applicants from this process. Applicants are also barred when the authority suspended or restricted their license within 12 months before surrender. Any required certificate of need must already be obtained. During review, the authority can issue a temporary license after an applicant certifies compliance with health and safety rules. An in-person inspection must first find no immediate danger to patients, and the authority can charge an unspecified temporary-license fee.
