Permit applicants get reasons and appeal guide

If the Department of Environmental Quality, Department of State Lands, State Department of Energy, or the State Department of Geology and Mineral Industries denies your permit, it must name the law or rule behind the denial. The agency must also give you a step-by-step guide to appeal, including the filing deadlines.

State agencies must track permit timelines

By July 1, 2029, these agencies must create a measure that tracks how fast they process permits and renewals. They must explain what slows reviews and which steps take the most time. They may suggest law or rule changes to speed things up. On or after July 1, 2039, an agency may stop using the measure. This requirement is repealed on January 2, 2040.

When the new permit rules start

The law takes effect 91 days after the 2026 regular session ends. Until then, current permit rules stay in place. After that date, agencies must follow the new denial-notice rule, and the performance-measure timeline toward July 1, 2029 begins.
