The Department of Environmental Quality, Department of Transportation, Department of State Lands, State Department of Energy, and the State Department of Geology and Mineral Industries must post on their websites who to contact with questions about each rule they adopt, change, or repeal. This helps businesses, landowners, and the public find the right person for answers. It takes effect on the act’s effective date (the 91st day after the 2026 regular session ends). This does not change legal duties or payments.
The Environmental Quality Commission, Oregon Transportation Commission, State Land Board, Department of State Lands, and the board of the State Department of Geology and Mineral Industries must follow new timelines. For permanent rules that create or change compliance duties, a rule cannot start sooner than 28 days after it is filed with the Secretary of State. This applies to rules with effective dates on or after January 1, 2027. Before adopting, changing, or repealing such a rule, agencies must give notice: in the Oregon Bulletin at least 21 days before filing; to people who asked for notice at least 28 days before filing; and by email only to the people named in ORS 183.335(15) at least 49 days before filing. Agencies must also give notice in the way their own rules require. These notice rules apply when the agency gives its notice on or after the act’s effective date (the 91st day after the 2026 regular session ends). These timelines do not apply to emergency or temporary rulemaking under ORS 183.335(5).
