Faster court arraignments after arrest

Once charges are filed, the court where they were filed must arraign you quickly. If you are in custody, the court arraigns you during the first 36 hours of custody, not counting Saturdays, Sundays, or holidays, unless there is good cause or you ask for a delay. If you are not held, the court arraigns you within 96 hours after arrest, not counting weekends, holidays, or times the court is closed during normal hours; exceptions in ORS 133.060 still apply. These timing rules apply only to cases with accusatory instruments filed on or after the law’s start date. The law takes effect on the 91st day after the 2026 regular legislative session ends.
