Tax credit for creating Oregon jobs

Businesses in qualified industries get a $1,000 state income tax credit for each certified net new Oregon job. You can claim up to 10 jobs per tax year (up to $10,000). Each counted job must pay at least 150% of the applicable minimum wage. You need written certification from the Oregon Business Development Department before you claim. Unused credit carries forward for three years, limited by your tax bill.

Pause on zone breaks for data centers

Oregon stops new enterprise zone authorizations for data center projects until 90 days after the 2027 regular legislative session ends. The ban section is repealed on January 2, 2029.

Longer zone tax breaks with wage rules

Enterprise zone property tax exemptions can extend past three years by written agreement. Extensions can last two more years, or up to 10 years when approved for major investments or regional impact. New hires under these deals must be paid at least 150% of the county average wage (130% in qualified rural counties) and not less than 100% of the county average. Sponsors and firms can agree to phased or delayed hiring or other measures like job retention, in a written plan. These flex rules and extensions do not apply to data center property.

Fast-track state permits for big projects

Oregon creates a Joint Permitting Council in the Governor’s office to coordinate permits. The council runs a fast-track program for large projects that need multiple state approvals. To qualify, investment must exceed $100 million in certain urban areas, $50 million elsewhere, or $25 million in nonurban counties, and meet readiness and industry-target rules. The Governor must approve and cannot approve when 15 projects are already in the program. Approved projects get a plan with shorter timelines, a lead agency, and monthly updates.

New rules on enterprise zone eligibility

Enterprise zones now must be backed by local evidence, like redevelopment-ready land and economic transition needs. Sponsors must align zones with local and regional development and climate or energy goals. Eligible firms focus on business-to-business work such as making, processing, shipping, or storage. Most retail, housing, child care, tourism, and most health care are excluded. A sponsor can seek a waiver for excluded firms by showing substantial community benefit. Sponsors may name priority industries by resolution, and commonly owned firms can elect to be treated as one.

New enterprise zone filing fee

Zone sponsors can charge an application filing fee after they adopt a fee policy. The fee is capped at the greater of $200 or 0.1% of your proposed investment in qualified property. You must use state-prescribed forms and file with the sponsor. A preauthorization meeting with the county assessor may be required. Late filings are allowed only if rules allow or the Department of Revenue waives the deadline.
