New license rules and fees for lenders

To get a consumer finance license, you file the state form. You list owners, key officers, and home and business addresses. You give an NMLS ID, fingerprints for background checks, and a work history. You authorize NMLS to pull your credit and legal records. You pay a state-set license fee when you apply, which covers the rest of the calendar year. If the director denies the license for cause or you withdraw after an investigation, you get a refund minus administrative and investigation costs.

When these loan rules start

The law takes effect on the 91st day after the 2026 regular session ends. The changes apply only to consumer finance loans made on or after that start date. Loans made before that date are not covered by these new rules.

Which consumer loans Oregon now regulates

The law covers consumer loans of $50,000 or less to people who live in Oregon. It also covers agents and brokers who arrange these loans. A loan counts if the borrower entered the loan while in Oregon or pays from an Oregon account. Oregon says a 1980 federal change does not apply to these loans, so the state uses Oregon law. Loans made and payable outside Oregon that are lawful there generally stay under that other state’s law. This chapter does not take away rights under other lending laws when lenders follow those laws.
