If a landlord sets occupancy limits, they cannot be stricter than two people per bedroom. Any limit must be reasonable. Reasonableness can consider bedroom size, unit size, and possible discrimination under ORS 659A.421. A bedroom is a room mainly for sleeping, at least 70 square feet, with a workable fire exit. Habitable rooms include living, sleeping, eating, or cooking areas. Bathrooms, closets, halls, storage, and similar spaces are not habitable rooms.
Landlords can ban smoking inside units and interior common areas. This applies only if your unit shares a wall or was built under a listed development agreement. The ban does not apply to accessible units. Fixed‑term leases do not change until the term ends. The landlord must post at least one smoking area on the property. The landlord must give you written notice at least 180 days before the change. Your rental agreement must say if smoking is banned, allowed everywhere, or allowed only in listed areas. This disclosure rule does not cover agreements for facility space under ORS 90.505 to 90.850. For rentals, “smoking” means inhaling or holding a lit tobacco product. These changes apply to existing and new rental agreements once the law takes effect.
