Backup grants if providers are barred

The law creates a grant program that turns on only if a state or federal action stops these providers from staying enrolled in Oregon Medicaid. Eligible providers are nonprofit reproductive health clinics that got more than $800,000 in Medicaid reimbursements in 2023 and are not eligible for federal Medicaid funds. Grants should match what the provider would get under the state fee‑for‑service system when possible. Grants cannot use federal Medicaid money. If the trigger happens, the program starts on that action’s effective date and OHA must notify Legislative Counsel right away.

Limits on CCO clawbacks for past claims

For claims a coordinated care organization (CCO) paid between July 4, 2025 and this Act’s 2026 effective date, a CCO can recover overpayments only for routine business reasons. A CCO cannot take back payment just because the provider is not eligible for federal Medicaid funds. This protection ends January 2, 2028.

State pays certain reproductive providers directly

The Oregon Health Authority (OHA) now pays certain nonprofit reproductive health providers directly, using a state fee‑for‑service system. These are providers enrolled in Oregon Medicaid that are not eligible for federal Medicaid funds. Beginning July 4, 2025, OHA pays claims only when the claim is not eligible for a federal Medicaid match and the provider has not yet been paid. OHA is the sole payer for these claims, including for coordinated care organization (CCO) members, and it cannot use federal Medicaid funds. OHA must update billing systems and keep enrollment standards aligned with Medicaid rules. It must also review payment rates at least every two years to make sure access to care is protected.
