Disclosures and penalties for investor buys

If a covered entity relies on the 90‑day listing exception, it must give the seller a completed, notarized disclosure and send a copy to the Oregon Department of Justice within three days. The Department posts these disclosures and keeps them online for at least five years. The Attorney General can investigate and sue to enforce the rules. Penalties can reach up to $250,000 for an illegal purchase and up to $10,000 for failing to file forms, plus investigation costs and attorney fees. Recovered money goes to the DOJ Protection and Education Revolving Account, and the law lets DOJ use that account to fund these enforcement cases.

Limits on large investors buying homes

The law limits when large, funded investors can buy fee title to single‑family homes. A covered entity is an institutional investor or an entity it funds. An institutional investor meets three tests: scale of ownership (2,500+ single‑family homes or 10% interests in 2,500+), serves as a fiduciary for pooled investor funds, and manages $1 billion or more in assets on any day in the current tax year. The $1 billion threshold is adjusted each year starting in 2026 using the Consumer Price Index for All Urban Consumers, West Region (All Items). A single‑family residence excludes any “middle housing” defined in ORS 197A.420. Covered entities may buy only if an exception applies, including: the home will be the owner’s principal residence; it uses government funds; it is tenant‑occupied or built for tenants; it is an off‑market sale; it is acquired by foreclosure or similar process; or it has been publicly listed for at least 90 straight days. These rules apply to offers made on or after the law’s effective date.
