Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Safety warnings required on new aerosol dusters

Aerosol dusters containing 1,1-difluoroethane (DFE), manufactured on or after January 1, 2026, must carry qualifying labels before sale or delivery. Warning labels must explain that inhaling the product to get high can cause harm or death. The warning must be at least as large as other warnings; substantially similar warning wording is allowed. Labels can instead follow the Federal Hazardous Substances Act and related federal rules. The national poison-control number, 1-800-222-1222, must appear where required by the chosen labeling option.

Age checks and purchase limits for dusters

Beginning January 1, 2026, Oregon bars retail sales or deliveries of aerosol dusters containing 1,1-difluoroethane (DFE) to anyone under 18. Sellers must check ID, including for recipients using pickup or third-party delivery. Accepted IDs include passports, driver’s licenses, Oregon ID cards, military IDs, and other state photo IDs showing name, birth date, and physical description. The ID must reasonably show the person is at least 18 and accurately describe them. Sellers must keep these dusters out of direct public reach and limit each individual to three per transaction. Sales to manufacturers, distributors, retailers, office wholesalers, and other businesses are exempt from ID checks, storage rules, and quantity limits. Violating the retail-sale and age rules is a Class C misdemeanor. Sellers charged with selling to a minor have a defense when they reasonably relied on accepted ID in good faith. These safeguards protect youth but restrict consumer access and add duties for sellers.
