Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Homeowners face limits on lumber claims

Third-party graded lumber bears a valid grade stamp from an accredited grading agency. Its manufacturers, distributors, wholesalers, retailers, and graders cannot be held partly or fully liable for failures or defects in self-graded lumber. This protection applies only when both types of lumber are used in the same structure permitted under the self-graded process. It limits homeowners' ability to seek recovery from those parties for self-graded lumber defects, not defects in their own lumber. This liability limit expires January 2, 2033.

Self-graded lumber for homes requires disclosures

Oregon's Department of Consumer and Business Services must create a process for builders, designers, and owners to use self-graded lumber. This means lumber tested and approved by a person certified through the training pilot. Use is limited to structures covered by the Oregon Residential Specialty Code. Applicants must disclose this use in writing to a licensed building inspector when applying for a building permit. The disclosure must be filed with the county clerk as part of the property's permanent deed record. Lumber must have a known source, with a documented relationship or permit between its owner and the milled lumber's purchaser. The process cannot create or accept new lumber grades or design values in the state building code. These rules expire January 2, 2033.

New lumber grader training and renewal rules

Oregon State University Extension must offer a lumber grading training pilot each year, consulting with the state's building regulation department. Training includes at least eight instructional hours, with hands-on practice using physical lumber samples. It covers local wood species, moisture, and visual grading rules for lumber used to support buildings. Extension sets completion and certification requirements and issues certificates to successful participants. Certified graders must renew their certification every five years. Instructors need an accredited grader certification, seven years of relevant professional experience with knowledge of regional grading rules, or Extension-approved equivalent qualifications. Relevant experience includes lumber grading, quality control, or wood products education. Instructors must maintain their skills through industry involvement, refresher courses, or other Extension-approved methods. The pilot expires January 2, 2033.
