Oregon home health agencies and hospice programs cannot base covered workers’ pay on patient totals or visit counts. The ban covers direct and indirect ties, including bonuses, productivity-based raises, and pay linked to discipline. Excluded workers include home care workers, in-home agency direct caregivers, physicians, nurse practitioners, psychiatrists, psychologists, and volunteers. Supervisors classified under union agreements or certified by labor boards are also excluded. The law does not set replacement pay rates. Oregon’s Bureau of Labor and Industries enforces the ban, and its commissioner can issue rules. The agency gets $159,362 more from the General Fund for enforcement during the two-year period beginning July 1, 2025.
