Private contractors hired by the State Forestry Department cannot use this specific civil claim for intentional obstruction at Elliott. The exclusion removes exposure to damages and legal fees under that claim, not all possible legal liability. The claim still covers other qualifying state forestland and access roads there. Those lawsuits have a two-year filing deadline, and courts must award reasonable attorney fees and costs to the winning party.
The State Land Board takes over Elliott’s management, contracts, property, and related duties to maintain a world-class research forest. The board cannot sell forest land, but it can expand or exchange land to support the research mission. Exchanges must consolidate the forest and involve land, or land plus money, of about equal total value. For county-owned lands and certain county-related lands, affected counties must get notice, a chance to consult and comment, and adequate compensation.
Elliott’s operating revenues, including forest products, carbon credits, and leases, go into a separate state account instead of the Common School Fund. The Department of State Lands has ongoing authority to spend this money on forest management and land transactions. Gifts and grants must follow donor limits; unrestricted gifts can support forest care and improvements consistent with its research mission. The state can also use financing agreements for projects or purchases tied to owning, running, or managing Elliott. The law sets no financing amount or repayment terms.
