Oregon changes which estates qualify for the simple estate affidavit process. The general limits are $75,000 in personal property, excluding manufactured homes, and $200,000 in real property and manufactured homes combined. For estates with a will, these caps can apply to gifts to beneficiaries other than a qualifying trustee. The remaining estate must go to the trustee of a trust the deceased person established before death. The law also addresses specifically named gifts under the will. Property counts at its full fair market value, without subtracting debts or liens. Use the value at death unless filing more than one year later; then use a date within 45 days before filing. A qualifying manufactured home is a residential structure transported on public highways, with sleeping, cooking, and plumbing facilities. It must meet the federal manufactured housing standards in effect when built. These changes apply to people who die on or after the law's effective date. A coordination clause provides replacement rules if Senate Bill 168 becomes law.
