Paid leave fund setup and rules

Oregon creates a trust fund for Paid Family and Medical Leave. It holds worker and employer contributions, fees, penalties, and interest. The Employment Department can use the money without new yearly approvals to run the program and pay benefits. The director can set accounting rules and decide which contributions pay for each type of leave. The director cannot change how much employers and employees each pay, beyond what the statute already allows.

When paid leave fund rules start

The law takes effect on the 91st day after the 2026 regular legislative session ends. From that date, the fund rules, limits, and accounting powers apply to employers, workers, and claimants.
