New loans for mixed-income apartments

The Housing and Community Services Department provides below-market, short-term loans to build mixed-income apartments with both market-rate and income-restricted homes. Projects must include at least one unit for households earning under 120% of area median income. The Housing Stability Council can set a minimum share or number of these affordable units. The department sets who can borrow, interest rates and terms, how many units must be restricted, and how long units stay affordable; the minimum period is at least the loan term and is enforced with affordability covenants. The department also sets how to split shared costs, like parking and infrastructure, to the affordable share. State loans are normally behind private loans on the property unless the private lender agrees otherwise. By January 1, 2027, the department must adopt initial rules.

Housing agency prioritizes affordable homes

The law updates the housing department’s mission. Its financing now expressly targets affordable homes for lower-income households, including through mixed-income developments. This focuses future programs, rules, and funding on affordability.

State fund backs mixed-income housing

The law creates the Mixed Income Development Loan Fund in the State Treasury. Money comes from loan payments, state appropriations, authorized bonds, and other sources; interest stays in the fund. About $20 million is transferred into the fund to start the program. The fund is continuously appropriated to the Housing and Community Services Department to make and run these loans.
