Accessibility rules for funded new rentals

Beginning January 1, 2027, Oregon funds new subsidized rental projects only if they meet visitability and accessibility rules. A project counts as subsidized if it receives low‑income housing tax credits, HOME funds, Oregon Housing Fund money, or other grants or tax incentives run by the Housing and Community Services Department. At least one exterior route must be visitable, with a clear width of 32 inches or more. There must be a visitable route to a common living space and a powder room. Switches, outlets, and controls must be within reach. If the site has 20 or more contiguous units or a shared community room, it must include at least one accessible powder room for tenants and guests. The development must also meet federal Section 504 accessibility rules. In multistory buildings without an elevator, these rules apply only to ground‑floor units. Farmworker housing on a farm is exempt. Contiguous units include units on the same or touching tax lots, even if a public road separates them. "New" means newly built housing, not a remodel or renovation.

Oregon can require stricter housing access

Beginning January 1, 2027, Oregon can set housing accessibility rules that are stricter than the Americans with Disabilities Act or the Fair Housing Act. The law also ties the meaning of "accessible" housing to federal Section 504 and Fair Housing standards. State agencies can write rules and take steps before 2027 so the changes roll out smoothly.
