Limits on immigration enforcement in public facilities

The Attorney General must publish model policies to limit immigration enforcement in public schools, clinics, courthouses, shelters, and other public facilities. The Department of Justice must consult the Office of Immigrant and Refugee Advancement when making or updating these policies. Public bodies and their contractors are encouraged to adopt policies based on them. The Attorney General can write rules to carry out this law. The law takes effect on passage.

K-12 policies for immigration enforcement

If Senate Bill 1538 becomes law, then starting July 1, 2026, new steps apply for K–12 settings. The Attorney General must also consult groups that represent school boards and school professionals when making K–12 model policies. Those policies must include checks for valid warrants, superintendent review of any response, encouragement to consult legal counsel, compliance with ORS 180.805 and 181A.826, and staff response guidance. School districts, education service districts, and public charter schools must give employees the applicable model policies.
