Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 1 costs, 1 mixed.

Disability appeal deadlines protect police and firefighters

For police officers and firefighters disputing final disability denials, the retirement board must refer hearing requests within 180 days. The deadline becomes 360 days if the member requests an extension. Missing that deadline means the member wins the dispute over the denial. Qualifying cases requested before the law took effect must be referred within 360 days after its effective date. That pending-case rule does not state a separate result for missing its deadline.

Easier disability access for police and firefighters

Police officers and firefighters can qualify for disability retirement or benefits when they cannot perform their job at disability onset. They no longer need to be unable to do all work for which they qualify. Board-selected doctors must find a lasting mental or physical incapacity, and the injury or disease cannot be intentionally self-inflicted. Non-duty-related disability retirement requires at least 10 years with a participating employer. Disability benefits require 10 years of retirement credit, or 10 calendar years of active membership for school employees, unless a duty-related injury or disease qualifies them.

Work ends disability benefits for public employees

Public employee disability benefits end when a member returns to any job, including self-employment. Separately, benefits end for a month when irregular or unpredictable earned income exceeds 10% of the member's pre-disability monthly salary. That salary is measured using the last full month of employment before disability began. The 10% threshold is not permission to return to a job while keeping benefits.

Police and firefighter pensions end after recovery

The retirement board must end police officers' and firefighters' disability retirement when they can again perform their job at disability onset. Members then become eligible for reemployment; a job is not guaranteed. Their retirement account is credited with the amount held when disability retirement began. Members not reinstated to employment are entitled to separation benefits or service retirement benefits.
