Extra eviction time for eligible infant families

From September 1, 2025, through September 27, 2027, eligible parents can delay a nonpayment eviction trial. The parent must receive medical assistance and live with their child under 12 months. They must also have approved health-related housing supports through the Oregon Health Authority or a coordinated care organization. They must give the landlord approval documents before or when filing a motion and supporting declaration. Filing is due at least three court days before trial, unless there is good cause for filing later. Sensitive details may be hidden, but not the parent's name or contact information. For qualifying requests, the court must set trial 90 to 104 days after the motion. During this period, required nonpayment eviction notices must explain the infant-family delay option and where to learn more. Beginning September 1, 2025, notices also direct renters to 2-1-1, 211info.org, local assistance providers, and legal aid. The Judicial Department must keep notices updated and post English, Spanish, Korean, Russian, Vietnamese, and Chinese versions prominently online.

Housing help priority for infant families

Effective on passage, Oregon's Housing and Community Services Department must prioritize families with children under 12 months when possible. This applies when setting housing stabilization rules or policies for people who are homeless or at risk of homelessness. The department decides when priority is possible; the law does not guarantee assistance or set a benefit amount. By September 15 each year, the department must report Oregon children's rate of unsheltered homelessness to legislative housing committees.
