Broader coverage for braces and artificial limbs

The law applies to Oregon individual and group health policies issued, renewed, or extended on or after January 1, 2026. Plans must cover medically needed artificial limbs and rigid or partly rigid supports for limbs or the torso. Devices must restore or maintain daily living or essential work activities, not serve only comfort or convenience. Coverage includes all medically needed services and supplies, including design, building, materials, fitting, alignment, and instructions for use. Medically needed repairs are covered when the person's health or the device's condition changes. Medically needed replacement of a device or part is covered for physical changes, damage that cannot be fixed, or repair costs above 60% of replacement cost. Plans must also cover the medically needed, most suitable device model for physical activity and whole-body health. Plans cannot deny activity-related device benefits for people with limb loss, impairment, or absence when they cover medical or surgical care for others to do the same activity. Managed care networks must offer medically needed care and devices through at least two distinct Oregon-based prosthetic and orthotic providers. The state must update its covered-device list annually, with coverage no narrower than Medicare's device schedule where consistent with this law. Other policy terms still apply. Public Employees' Benefit Board and Oregon Educators Benefit Board plans are exempt from the new requirements unless their boards elect coverage and notify the state department.

Extra checks for newer device replacements

This rule applies to Oregon individual and group health policies issued, renewed, or extended on or after January 1, 2026. Insurers may ask the prescribing provider to confirm that replacing an orthotic or prosthetic device or part is medically needed. This added check applies when the item being replaced is less than three years old. Insurers are allowed, but not required, to request confirmation. Public Employees' Benefit Board and Oregon Educators Benefit Board plans are exempt unless their boards elect coverage and notify the state department.
