Oregon law bars denying mental health assessments, treatment, or services solely because someone also has an intellectual or developmental disability. This protection covers all ages, expanding beyond people under 21. It applies to public bodies, community mental health programs, licensed or certified providers, education providers, and coordinated care organizations. Covered education providers include school districts, public charter schools, education service districts, approved recovery schools, and youth corrections education programs. They also include the Oregon School for the Deaf and state-operated programs providing education to students. The education-provider definition excludes the Oregon Youth Authority, Department of Corrections, and Department of Education, except when serving the deaf school. State health, human services, education, and provider licensing agencies must adopt rules to carry out these protections. The law takes effect on the 91st day after Oregon’s 2025 regular legislative session adjourns.
