Oregon public employers can recover wage overpayments through paycheck deductions only for overpayments made within 364 days before written notice. Employers must give written notice itemizing the overpayment and each deduction’s purpose at least 10 calendar days before deducting pay. Deductions cannot exceed 5% of gross pay per pay period unless the employee requests and specifies a higher amount or percentage. The notice must explain this cap and warn that any unpaid balance may be taken from the final paycheck when employment ends. These rules replace the prior wage-deduction law. The law also adds $114,461 in General Fund money for the Bureau of Labor and Industries to handle public employee overpayment wage claims during the two-year budget period beginning July 1, 2025.
