Bill Overview

Analyzed Economic Effects

6 provisions identified: 5 benefits, 0 costs, 1 mixed.

Declarations allowed for more court filings

People can use declarations instead of affidavits for specified court filings. These include requests to change court location, foreign-judgment filings, and temporary custody or parenting-time requests. Covered temporary requests seek to keep current arrangements before judgment or address immediate danger. Declarations must follow required forms and be under penalty of perjury where required.

Less paperwork for parents registering custody

Registering another state's child custody decision in an Oregon circuit court now requires one certified copy. Previously, the filing required two copies, including one certified copy.

More ways to handle jury paperwork

People age 70 or older, or facing undue hardship or extreme inconvenience, can request jury excuses by phone or mail. They can also use another court-approved method. Breastfeeding women can request an excuse in writing or through another court-approved method. Judges must provide a way to complete and return eligibility forms listing legal requirements by a specified date.

Sealed case records for qualifying renters

Courts must annually set aside qualifying judgments and seal official records in possession cases under Oregon's residential landlord-tenant law. The judgment must dismiss the case or otherwise favor the defendant, and at least 12 months must have passed. It must have no money award, or any award must have expired, been satisfied, or been discharged.

Free printed decisions for law schools

Beginning January 1, 2026, Oregon's Supreme Court must keep physical copies of court reports or advance sheets available. It must maintain at least one copy at the State of Oregon Law Library. Each accredited Oregon law school must also receive at least one free physical copy.

Legal fee awards in marital enforcement

Courts can award reasonable attorney fees in contempt cases enforcing orders from annulment, divorce, or legal separation cases. Awards can cover trial and appeal costs, but are not automatic. One party can recover legal costs while another must pay the award.
