Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Faster property titles in Special Communities

The law lets the Executive Director of the Office for Socioeconomic and Community Development (ODSEC) issue sworn certifications to register or transfer titles for properties funded by the Trust or ODSEC. The certification must describe the property and the funds used, and the Property Registry accepts it without the usual chain-of-title steps. The Housing Department and the Transportation and Public Works Department must transfer properties bought with Trust funds under Article 8 of Law 23-2021 to the Trust using this process. The Director must issue rules within 45 days to run these certifications and related title and registry steps.

Some Trust projects skip environmental reviews

Trust or ODSEC-funded projects inside a Special Community and in areas already impacted are excluded from filing an environmental document under Law 416-2004. Projects outside a Special Community or in areas not previously impacted still must complete environmental reviews. This speeds some community projects but reduces environmental review protections in those areas.

Clear leadership and support for the Trust

The law names ODSEC’s Executive Director as the fiduciary who manages the Perpetual Trust for Special Communities. The Trust’s board can appoint a different fiduciary by absolute majority. ODSEC must provide staff to give technical and administrative support to the Trust. The Trust’s founding deed must be recorded at the Office of Notary Inspection; this does not change the Trust’s validity or rights.

Lower costs and rules for Trust property

When ODSEC or the Trust act to benefit residents in Special Communities, they do not pay stamps, fees, tariffs, or taxes for public documents. The exemption also covers filings at the Property Registry, other public registries, and permit fees at the Permits Management Office and municipal offices (hierarchies I–V). Deals or legal transactions involving Trust or ODSEC real property for community benefit are exempt from Law 26-2017, reducing steps for these transfers.
