Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 0 costs, 3 mixed.

Governor can reorganize executive agencies

The Governor can evaluate all executive agencies and propose changes, except those listed in Article 2.01. Reorganization Plans can create, combine, transfer, or externalize agencies, programs, and services. Plans can also give specific rulemaking and hearing powers to agencies, and must list any obsolete or conflicting laws. Plans are subject to legislative approval.

Streamlined agencies with worker protections

The law makes cutting public spending and faster service official policy. Agencies must review services and remove overlap or obsolete work. Reorganization Plans must list laws that are obsolete or conflict with them and cannot merge agencies protected by the Puerto Rico Constitution. Agency heads must help find these laws and carry out the policy. Regular public employees keep their status; agencies must reassign, not dismiss, them under Law 8-2017.

Strict deadlines for reorganization plans

The Governor must file repeal and enabling bills with a Plan or within 15 days after approval. Missing the 15-day deadline makes the Plan void. The Legislature has until the last day of that session or 40 days after filing, whichever is later, to act. If the bills do not become law, the Plan is void. Any agency actions before approval are provisional and must follow existing law. The law also cancels any procedural rules that conflict with these requirements.
