Higher penalties for Puerto Rico energy violators

Effective immediately upon approval, Puerto Rico's Energy Bureau can fine regulated parties $10,000 to $125,000 daily for each violation. This covers violations of the energy law, its rules, or Bureau orders. The cap is the largest of 5% of annual gross sales, 15% of annual net income, or 10% of net assets. These figures use the prior or most recent applicable tax year; private operators' gross sales include customer service fees. Violations continuing after an initial penalty can bring added fines of $15,000 to $250,000 daily per violation. A unanimous Bureau decision allows up to double the sales-, income-, or asset-based caps. The Bureau can seek account freezes and require government entities to deposit money owed to a sanctioned party, up to the sanction amount. It can collect from those deposits only after the sanction is final and no longer appealable. Intentional violations are felonies, punishable by up to 18 months in prison or a court-set fine of $1,500 to $25,000. Repeat offenses carry court-set fines of $50,000 to $100,000.

Electricity customers get credits from collected fines

Private energy operators in Puerto Rico must pay fines from their own money, not customer rates or sources affecting rates. These fines are disallowed costs under their contracts with the government. The Puerto Rico Electric Power Authority must use non-rate revenue, or its operating budget if that revenue is insufficient. The Energy Bureau must keep collected administrative fines in a separate account and periodically credit electricity customers through quarterly fuel-cost reviews. The law sets no dollar amount for each customer's credit and takes effect immediately upon approval.
