Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Election-year limits on government ads

From January 1 of each general election year until final certification, strict ad rules apply. All branches and municipalities cannot spend public funds on ads or materials that praise or attack candidates, parties, or officials. This includes paid media buys, promotional items, and paid social posts. Official websites and accounts can stay active, but must avoid party slogans, symbols, or “achievement” pitches. The Electoral Comptroller issues clear rules, requires online filings, and sets deadlines. Ordinary requests are filed 20 days before publication; expedited, 5 days. The office decides in 15 days (ordinary) or 5 days (expedited); if it does not, approval is deemed. Emergency messages need no prior approval if they avoid political content. Agencies may post neutral notices about public works, including federally funded projects. The Comptroller enforces these rules and cannot expand the law’s exceptions.

Municipal hiring freeze before elections

Municipal appointing authorities must pause personnel moves from two months before the general election until the second Monday in January. The freeze covers hires, promotions, transfers, demotions, reclassifications, pay changes, and job category changes. Needed actions can happen only with prior approval from the Office of Administration and Transformation of the Government. Any move made without that approval is null. If the incumbent mayor is preliminarily certified re‑elected, the freeze ends then. But if the margin is 100 votes or less, 0.5% or less, or there is a contest or recount, the freeze continues until the official certification or the second Monday in January, whichever comes first.
