New tools to enforce parent rights

If the Department repeats a violation and does not fix it in a reasonable time after you notify it, you can ask a court for a mandamus order. You can also seek punitive damages under applicable law. The Department must adopt rules within 90 days of approval, and those rules start on the first day of the next school semester after adoption. Rules must expand parents’ rights, and no agency or court can read them to narrow those rights.

Stronger parent rights in public schools

You have a fundamental right to direct your child’s education, even while your child is at school. Schools back you up, not replace you. You can get regular information on your child’s progress and on the school’s performance. Students must receive 180 school days each year, with six hours a day with a qualified teacher. You can request services like transportation, school meals, health services, individualized study, and reasonable accommodations, and any denial or delay must be explained. Schools must be safe and inclusive and may not discriminate, including against protective hairstyles or traditional religious dress. At least once a month, and in emergencies, you can share your views without disrupting classes.

Parents control sex education at school

You have the exclusive right to decide how your child is taught about sexuality and affectivity. The Department must give timely notice of any related class or event. You may object to content, and if that content is required to pass, your child must get an alternative evaluation.
